General contractual conditions
This contractual document will govern the purchase of products and services of the Fuente Real Apartments through the website [www.fuentereal.es], property of FUENTE REAL INVERSIONES, S.L.
The acceptance of this document implies that the USER:
- Has read, understands, and comprehends what is set out herein.
- Is a person with sufficient capacity to undertake a contract.
- Assumes all the obligations set out herein.
These conditions will be valid for an indefinite period and will be applicable to all contracts made for the Fuente Real Apartments in Barrio de Sobrellano, Comillas (Cantabria).
FUENTE REAL INVERSIONES, S.L. reserves the right to unilaterally modify the conditions, without affecting the goods or promotions that were contracted prior to the modification.
Terms and conditions of use
The following conditions apply to all the apartments managed under the name of APARTAMENTOS FUENTE REAL, please check that you agree with all the terms and if you have any questions, please do not hesitate to contact us at: firstname.lastname@example.org
The property currently has several types of apartments, the characteristics of which are specified on the website www.fuentereal.es, specifically in the “APARTMENTS” tab.
The establishment consists of two types of apartments: three two-bedroom units and one one-bedroom unit.
The two-bedroom apartments have a maximum capacity of 4 people. One of the bedrooms contains a 150cm double bed and the other bedroom has a 135cm bed. There is also a sofa bed in the living room. These apartments have a private bathroom and a kitchen-living room, fully equipped with electrical appliances (dishwasher, washer-dryer, microwave, fridge and coffee maker).
The one-bedroom apartments have a maximum capacity of 3 people. The bedroom contains a 150cm double bed and there is a sofa bed in the living room. These apartments have a private bathroom (with bath and shower) and a kitchen-living room, fully equipped with electrical appliances (dishwasher, washer-dryer, microwave, fridge and coffee maker).
Children under two years of age can stay in any of the apartments as additional guests, sleeping in a cot and at no extra cost.
Children over two years of age will sleep on a bed or sofa bed and will be counted as part of the maximum 3 or 4 guests allowed, depending on the accommodation. Therefore, children over 2 years of age will count as an additional adult and there will be no additional discount for their stay.
The number of persons appearing on the reservation must be the number of persons occupying the apartment. Children under 2 years of age will not be counted as occupants but we must be informed of their stay and you may request a cot free of charge.
Under no circumstances can the number of people staying in the apartment be greater than the maximum number of people for the apartment in question. If this is the case, we will be obliged to proceed with the eviction of the apartment and disallow the stay, without refunding the amount paid for it.
Prices and reservations
Pricing is quoted per apartment per night, and this will not vary according to the number of guests staying in the apartment. As mentioned above, the number of guests may not exceed the number of persons established by law.
All basic apartment services (electricity, gas, cold water and hot water) are included in the rental price.
The establishment will set a minimum number of nights per stay, depending on the time of year, or will apply whichever pricing structure it deems appropriate, depending on the duration of stay, and the time of the stay.
Reservations for Fuente Real Apartments may be made directly through the website, by email and telephone to the establishment or through other means of marketing or advertising. The client will receive written confirmation of their reservation and must provide same upon arrival at the establishment for the booking to be deemed valid.
Any incident in relation to bookings made through external operators and third parties must be resolved directly with the responsible suppliers, with APARTAMENTOS FUENTE REAL being exempt from any responsibility.
The reservation of one or more apartments will always be accompanied by a deposit of 30% of the total amount of the reservation. Any reservation will be noted, but not confirmed until this amount has been paid, which will be deducted from the client’s final invoice. On arrival at the apartment on the first day, the client must pay the full amount due.
Online payment security
The property of Fuente Real Apartments takes every precaution to protect your credit card information by using ‘secure payment’ systems.
On arrival the client must leave a deposit of 200€, which will be charged to a credit card to be provided by the client, upon arrival at the establishment. The security deposit will be used to cover the costs of repairing any damage or breakage in the apartment, as well as any missing items in the inventory, etc.
The day after the end of the client’s stay, after checking that everything is in order, the deposit will be refunded. If any damage, breakage or reduction to the inventory is found in the apartment, the deposit will be withheld. The damages will be assessed and the corresponding part of the deposit will be deducted from the deposit. The difference, if there are monies leftover, will be refunded to the client’s credit card. The deposit will also be withheld in whole or in part if the “cleaning” section referred to below is not complied with, when the apartment does not meet the minimum conditions of order and cleanliness (kitchen tidy, furniture in its place, etc.).
All apartments are cleaned before the arrival of guests. The cleaning of the apartment during their stay is the responsibility of the occupants, with cleaning products provided in the apartments. On leaving the apartment, the client must leave the apartment as it was handed over to him/her. If the apartment is not in a good condition, the amount of 60 € may be withheld. If any kitchen utensils, towels, sheets, blankets, etc. are missing, the corresponding amount may be retained based on the purchase invoice plus 25% for the damages caused.
For stays of more than 3 nights, an additional cleaning service of the apartment can be hired in two formats:
- General cleaning. A cleaning service limited to floors and bathroom, excluding the cleaning of kitchenware, making of beds or tidying personal belongings.
- Full/Deep cleaning. The apartment is thoroughly cleaned and guests will return to find it as it was presented at check-in.

Cancellations and changes to the booking
Cancellations and changes requested by the client will be subject to the following conditions:
- Non-refundable deposit. If the booking is cancelled or modified up to 5 days before the date or day of arrival at the establishment, no additional charge will be made and the deposit paid will be refunded (exceptions are listed on the website). The refund will be made within one month of the booked arrival date. If the cancellation is made less than 5 days before the date of arrival, the 30% deposit paid in advance will not be refunded.
- Entire holiday charged without the right to a refund. If the booking is cancelled or modified less than 48 hours before the date of arrival at the establishment, the full amount will be charged (exceptions are listed on the website).
- If the deadlines for free cancellation/modification are not met or if the client does not show up at the establishment on the scheduled date, the entire stay will be charged. (E.g. in July, August and September, if your arrival is to take place on Friday and a cancellation is made after 00:00 on the previous Monday, the deposit will not be refunded).
- If a customer, having occupied their apartment, wishes to shorten his/her duration of stay, the total charge for the stay will not be modified and s/he will not be entitled to a refund.
In the event that the client wishes to change reservation dates, if those dates are available and the request falls within the period of advance notice as indicated in the previous point, it will be handled free of charge. If this is not possible, the cancellation conditions will be applied.
In most cases, when the client communicates that he/she wants to change the apartment type, the request will be accepted if the other type of apartment is available. If the client decides not to proceed, the cancellation conditions previously detailed will be applied.
Conditions of cancellation by Fuente Real Apartaments
If accommodation cannot be taken up by the client due to overbooking or unforeseen causes attributable to Apartamentos Fuente Real, the client will be contacted as soon as possible and an attempt will be made to find an alternative, making available other accommodation of the same characteristics within the same establishment. If the aforementioned option is not possible or if the client rejects the change or modification, the booking will be cancelled and the full amount advanced will be refunded immediately.
In the event that, for reasons of force majeure (such as restoration work, repairs, maintenance, etc.), Apartamentos Fuente Real cannot offer the apartment booked, an attempt will be made to offer accommodation located in the same area with similar characteristics and the advance payment will be refunded.
Arrival and departure of guests
Guests must inform us of their approximate time of arrival because we do not operate a 24hour reception service.
On arrival the check-in documentation will be completed, the apartment will be shown and the security deposit will be charged by card. Please provide proof of ID such as a passport, for the necessary registration with the relevant authorities, and a credit card for the security deposit.
Check-in to the apartment will take place from 5pm until 8 pm. Check-out must take place at 12 midday at the latest, handing the keys to the person in charge of the establishment.
The establishment does not have a left-luggage service for luggage, nor will it take charge of any of the guests’ belongings once they have left the apartment.
The establishment has a telephone number (+34 942 133 133) to answer any queries you may have during your stay, from 9am to 8pm. For any exceptional emergency, you can contact this number outside these hours.
In our apartments, NO domestic pets of any kind are allowed.
Each guest is responsible for his/her own behaviour, however, we will hold the person who represents the clients in the “BOOKING REQUEST” as the person ultimately responsible.
Out of consideration for our neighbours, parties and get-togethers are not allowed under any circumstances. Quiet times must be respected from 12 midnight to 8am. If these rules are not adhered to, the property reserves the right to disallow the stay. Failure to comply with these rules will force us to vacate the apartment without any refund or compensation to the guests.
Parking rules and use of the car park
Each apartment has only one parking space. You will be given a single remote control when you arrive at the establishment to open the parking gate and you must return it in perfect condition, together with the rest of the keys, when you leave the apartment. The value of this remote control is set at 40€. Its loss or any damage will be deducted from the deposit.
The guest is directly and exclusively responsible and exempts Apartamentos Fuente Real from all liability for any damage that may be caused to persons or things as a result of the use of the carpark, whether derived from improper use of either the parking space and/or the facilities, access doors etc. Similarly, Apartamentos Fuente Real is not responsible for possible theft, robbery or vandalism that others may cause, either outside and/or inside the vehicle.
Apartamentos Fuente Real is not responsible for any direct or indirect damage that may be caused during your stay in the apartment or parking space, including but not limited to all types of damage.
Neither is it responsible under any circumstances for the objects that guests may take with them during their trip and that are left in the apartment or in the car park. Nor is it responsible for any loss or damage to personal belongings due to fire, flood, theft or criminal behaviour.
Acceptance of conditions
Booking an apartment at Apartamentos Fuente Real means that you accept all the terms and conditions stated here.
If you have any complaint about the accommodation, it must be communicated to the contact person to be rectified. Tourist complaint forms are available.
After the end of your stay, you have no right to assert a claim.
These conditions of use shall be interpreted in accordance with Spanish law. The client is obliged to accept these conditions of use before carrying out any transaction with Apartamentos Fuente Real. The client is responsible for reading and understanding these conditions of use before accepting them. Any claim or legal action will be referred to the Courts of Cantabria.
